Common Questions

How long do I have to file a claim?

In California, the deadline to file a lawsuit for most personal injury claims is generally two years from the date of the injury (Code of Civil Procedure § 335.1). Claims against a government agency usually require a written claim within six months (Government Code § 911.2). Deadlines can be shorter or longer depending on the facts, so do not wait.

What should I do right after an accident?

Get medical care, report the accident, take photos, collect the other driver’s and witnesses’ information, and keep all bills and records. Avoid giving a recorded statement to the other driver’s insurance company before you speak with an attorney.

The insurance company already offered me a settlement. Should I take it?

Early offers are often made before the full extent of your injuries is known. Once you sign a release, you usually cannot reopen the claim. It is worth having the offer reviewed first.
