Common Questions

Do I need a will or a trust?

It depends on your assets, your family, and your goals. A properly funded living trust can help your family avoid probate, which in California can be time-consuming and expensive. A will is still important for naming guardians for minor children and covering anything outside the trust.

What happens if I don’t have an estate plan?

California law decides who inherits your property, and your family may have to go through probate court. A plan lets you choose who receives your assets and who makes decisions for you.

How often should I update my plan?

Review it after major life events, such as marriage, divorce, a birth, a death in the family, a move, or a significant change in assets, and at least every few years.

What if an asset was never transferred into the trust?

That is a common problem. Depending on the situation, a court petition may allow the asset to be treated as part of the trust without a full probate. I can review the documents and explain the options.
